Statutory Instrument 1997 No. 2919The Education (Student Loans) (Amendment) Regulations 1997(The document as of February, 2008) STATUTORY INSTRUMENTS1997 No. 2919The Education (Student Loans) (Amendment) Regulations 1997
In exercise of the powers conferred by section 1(2) and (7) of the Education (Student Loans) Act 1990[1], the Secretary of State for Education and Employment hereby makes the following Regulations: 1.These Regulations may be cited as the Education (Student Loans) (Amendment) Regulations 1997 and shall come into force on 1st January 1998. 2.The Education (Student Loans) Regulations 1997[2] shall be amended by inserting after paragraph 4 of the Schedule the following paragraph:
(b) before 1st August 1997 the student commenced attending a course in respect of which he was eligible for a loan, and
(ii) in like fashion commenced attending another course or courses one after the other in respect of each of which he was eligible for a loan, until in like fashion he commenced attending his present course."
(This note is not part of the Regulations) These Regulations, which come into force on 1st January 1998, amend the Education (Student Loans) Regulations 1997 ("the principal Regulations"). The principal Regulations included a new condition of eligibility for student loans. Subject to some exceptions a student is now required to be settled in the United Kingdom within the meaning of the Immigration Act 1971. The amending Regulations provide that this condition shall not apply to students who began their courses before 1st August 1997, or who from before then and without break have been attending courses for which they have been eligible for loans.
