CONTAMINATION OF FOOD

The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1997 Partial Revocation Order 1997

The Secretary of State, in exercise of the powers conferred on him by section 1(1) and (2) and section 24(1) of the Food and Environment Protection Act 1985[1], and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement
    1.This Order may be cited as the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1997 Partial Revocation Order 1997 and shall come into force at 18.00 hours on 18th July 1997.

Revocation
    2.The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1997[2] is revoked insofar as it designates any part of the area set out in the Schedule to this Order.

SCHEDULE
Article 2

The area of sea around the Orkney Islands below mean high water springs enclosed by a line extending from the point at 58° 45'N and 3° 30'W then due north to the point at 59° 00'N and 3° 30'W, then due east to the point at 59° 00'N and 3° 00'W, then due north to the point at 59° 15'N and 3° 00'W, then due east to the point at 59° 15'N and 2° 30'W, then due south to the point at 58° 45'N and 2° 30'W, then due west to the point of starting.



EXPLANATORY NOTE

(This note is not part of the Order)


This Order partially revokes the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1997 which prohibited-

    (a) fishing for or taking shellfish within the area designated in the Schedules to that Order (article 4);

    (b) movement of such shellfish out of that area (article 5); and

    (c) landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such shellfish from the designated area within the United Kingdom (article 6).

The effect of this Order is to remove the prohibition from fishing for, taking, moving, landing, using in food production and supplying the shellfish affected by the Order, from the area designated in the Schedule to this Order.
