The Dual-Use and Related Goods (Export Control) (Amendment No. 3) Regulations 1997

The Secretary of State, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the control of the export of goods and measures relating to trade in dual-use goods, in exercise of the powers conferred on her by that section hereby makes the following Regulations:

    1.These Regulations may be cited as the Dual-Use and Related Goods (Export Control) (Amendment No. 3) Regulations 1997 and shall come into force on 6th August 1997.

    2.In the definition of "the Decision" in regulation 2 of the Dual-Use and Related Goods (Export Control) Regulations 1996[3] - 

    (a) the word "as" shall be inserted before the word "amended" where it first appears, and

    (b) the following words shall be added at the end:

      " and as further amended by Council Decision No. 97/419/CFSP of 26 June 1997[4]".

    3.The following entries in Schedule 2 to the said Regulations are hereby revoked:

EXPLANATORY NOTE

(This note is not part of the Regulations)


The Dual-Use and Related Goods Regulations 1996 contain references to Council Decision No. 94/942/CFSP of 19 December 1994 on the joint action adopted by the Council of the European Union on the basis of Article J3 of the Treaty on European Union concerning the control of exports of dual-use goods (O.J. No. L367, 31.12.94, p. 8). The Decision has now been further amended by Council Decision No. 97/419/CFSP. These Regulations amend the 1996 Regulations so that references to Decision 94/942/CFSP are to that Decision as further amended by Decision 97/419/CFSP.

A consequence of Decision 97/419/CFSP is that nine entries in Schedule 2 to the 1996 Regulations are redundant, and they are revoked by these Regulations.
