The Scottish Qualifications Authority (Establishment) (Scotland) Order 1996

    The Secretary of State, in exercise of the powers conferred on him by section 1(1) of the Education (Scotland) Act 1996[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Scottish Qualifications Authority (Establishment) (Scotland) Order 1996 and shall come into force on 18th September 1996.
    Establishment of Scottish Qualifications Authority
        2.    There shall be established a body corporate to be known as the Scottish Qualifications Authority.

EXPLANATORY NOTE

(This note is not part of the Order)
    Part I of the Education (Scotland) Act 1996 enables the Secretary of State by order to establish a new statutory body called the Scottish Qualifications Authority (SQA). This Order establishes that body on 18th September 1996, when most provisions of Part I of the Act come into force.
    SQA will not take up its substantive functions immediately. The property, rights, liabilities and obligations of the Scottish Examination Board and the Scottish Vocational Education Council will be transferred to SQA as their successor at a future date to be appointed by the Secretary of State, and the provisions of the Act giving SQA substantive functions will be commenced then.
