The Further and Higher Education Act 1992 (Commencement No. 3) Order 1996

    In exercise of the powers conferred by sections 89(4) and 94(3) of the Further and Higher Education Act 1992[1] the Secretary of State for Wales hereby makes the following Order:
        1.    This Order may be cited as the Further and Higher Education Act 1992 (Commencement No. 3) Order 1996.
        2.    Section 93(1) of the Further and Higher Education Act 1992 ("the Act"), so far as it relates to paragraph 10 of Schedule 8 to the Act and is not already in force, shall come into force on 1st August 1996.
        3.    Section 55(1) to (3) and (7)(b) of the Act shall (so far as not already in force) come into force on 1st August 1996.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order remedies an omission from the Further and Higher Education Act 1992 (Commencement No. 2) Order 1992 (S.I. 1992/2377) (C.79). Article 3 of that Order purported to bring paragraph 10 of Schedule 8 to the Further and Higher Education Act 1992 into force for certain purposes but did not bring into force section 93(1) of that Act, by virtue of which Schedule 8 has effect. Article 2 of this Order brings section 93(1) into force on 1st August 1996 so far as it relates to paragraph 10.
    The Order also brings into force section 55(1) to (3) and (7)(b) of the 1992 Act in relation to Wales. These subsections have already been brought into force in relation to England by the Further and Higher Education Act 1992 (Commencement No. 1 and Transitional Provisions) Order 1992 (S.I. 1992/831) (C.31), Schedule 3.
