The Highlands of Scotland Tourist Board Scheme Order 1995

The Secretary of State, in exercise of the powers conferred on him by section 172(1), (3) and (4) of the Local Government etc. (Scotland) Act 1994[1]and of all other powers enabling him in that behalf and after consulting the Scottish Tourist Board, The Badenoch and Strathspey District Council, The Caithness District Council, The Inverness District Council, The Lochaber District Council, The Nairn District Council, The Ross and Cromarty District Council, The Skye and Lochalsh District Council, The Sutherland District Council and The Highland Council in accordance with section 172(10) of that Act and after consulting the Council on Tribunals and its Scottish Committee in accordance with section 8 of the Tribunals and Inquiries Act 1992[2]hereby makes the following Order: Title and commencement 1. This Order may be cited as the Highlands of Scotland Tourist Board Scheme Order 1995 and shall come into force on 31st August 1995. Interpretation 2. In this Order"the scheme"means the Highlands of Scotland Tourist Board Scheme 1995; "the Board"means the Highlands of Scotland Tourist Board; "existing Board"means any area tourist organisation which is to be wound up and dissolved in accordance with paragraph 11(2) of the scheme; and "local government area"shall be construed in accordance with section 1(2) of the Local Government etc. (Scotland) Act 1994.
The Scheme 3.(1) Subject to paragraph (2), the scheme set out in the Schedule to this Order shall have effect, as from 1st April 1996, for the establishment of the Board for the local government area of Highland.
(2) The scheme shall have effect from the date of coming into force of this Order in relation to (a) the constitution of the Board; (b) the carrying out by the Board of any functions necessary to bring the scheme into operation on 1st April 1996; and (c) the winding up of an existing Board.
