The Financial Services Act 1986 (Commencement) (No. 13) Order 1995

Made14th June 1995

    The Treasury in exercise of their powers under section 211(1) of the Financial Services Act 1986[1] hereby make the following Order—
    Citation and interpretation
        1.—(1)  This Order may be cited as the Financial Services Act 1986 (Commencement) (No. 13) Order 1995.

        (2)  In this Order "the Act" means the Financial Services Act 1986.
    Provisions brought into force
        2.    Section 212(3) of and Schedule 17 to the Act shall come into force on 19th June 1995 to the extent necessary to repeal—
       (a) Part III of and Schedule 3 to the Companies Act 1985[2], and in Schedule 22 to that Act the entry relating to Part III, and in Schedule 24 to that Act the entries relating to sections 56(4), 61, 64(5), 70(1) and 78(1), for all remaining purposes except—
         (i) sections 58, 59 and 60 of the Companies Act 1985, in so far as it is necessary for the purposes of sections 81, 83, 246, 248 and 744 of that Act; and
         (ii) paragraph 2 of Schedule 3 to the Companies Act 1985, in so far as it is necessary for the purposes of section 83(1)(a) of that Act; and
         (iii) section 62 of the Companies Act 1985, in so far as it is necessary for purposes of section 744 of that Act; and
       (b) the corresponding provisions of the Companies (Northern Ireland) Order 1986[3], for corresponding purposes.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force on 19th June 1995 section 212(3) of and Schedule 17 to the Financial Services Act 1986, to the extent necessary to repeal Part III of and Schedule 3 to the Companies Act 1985 for all purposes except the interpretation of certain other provisions of the latter Act.(This note is not part of the Order)
