The British Coal Corporation (Change of Quorum) Regulations 1995

The Secretary of State, in exercise of the powers conferred by section 2 of the Coal Industry Nationalisation Act 1946[1] and now vested in him[2] and of all other powers enabling him in that behalf, hereby makes the following Regulations:
Citation and commencement
1. These Regulations may be cited as The British Coal Corporation (Change of Quorum) Regulations 1995 and shall come into force on 30th June 1995.
Amendment to the Coal Industry Nationalisation (National Coal Board) Regulations 1946
2. In regulation 4 (Quorum) of The Coal Industry Nationalisation (National Coal Board)[3] Regulations 1946[4]: (a) for the words "or deputy chairman is present unless neither of them is available and either of them" there shall be substituted "is present unless he is not available and" and
(b) for the word "five" there shall be substituted "three".

EXPLANATORY NOTE
(This note is not part of the Regulations)These Regulations amend the Coal Industry Nationalisation (National Coal Board) Regulations 1946 by substituting a quorum of three for the quorum of five required by regulation 4 of those Regulations in consequence of the appointment of 30th June 1995 as the date for the purposes of section 23(1)(a) of the Coal Industry Act 1994 (which reduces the required number of Members of the Corporation to the chairman and one other member). Also certain references to the deputy chairman are deleted.
