The Legal Aid in Criminal and Care Proceedings (General) (Amendment) (No. 2) Regulations 1995

The Lord Chancellor, in exercise of the powers conferred on him by sections 21(5), 34 and 43 of the Legal Aid Act 1988[1], and with the consent of the Treasury, hereby makes the following Regulations:—
Citation, commencement and transitional provisions
1.—(1) These Regulations may be cited as the Legal Aid in Criminal and Care Proceedings (General) (Amendment) (No. 2) Regulations 1995 and shall come into force on 10th April 1995.
(2) These Regulations apply to applications for legal aid made on or after 10th April 1995 and applications made before that date shall be treated as if these Regulations had not come into force.
Amendments to the Legal Aid in Criminal and Care Proceedings (General) Regulations 1989
2. Schedule 4 to the Legal Aid in Criminal and Care Proceedings (General) Regulations 1989[2] shall be amended by substituting for the words from "by which his" to the end, the words "by which his average weekly disposable income exceeds £47; but any applicant or appropriate contributor whose average weekly disposable income does not exceed £48 shall not be liable to pay a contribution.".

EXPLANATORY NOTE
(This note is not part of the Regulations)These Regulations amend the Legal Aid in Criminal and Care Proceedings (General) Regulations 1989 by increasing the income limit for non-contributory criminal legal aid from £46 per week to £47 per week.
