COAL INDUSTRY

The Coal Industry Act 1994 (Commencement No. 2 and Transitional Provision) Order 1994

    The Secretary of State, in exercise of the powers conferred on him by section 68(4) and (5) of the Coal Industry Act 1994[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation, commencement and interpretation
        1.—(1)  This Order may be cited as the Coal Industry Act 1994 (Commencement No. 2 and Transitional Provision) Order 1994 and shall come into force on 31st October 1994.

        (2)  In this Order—
      "the Act" means the Coal Industry Act 1994; and

      "the 1946 Act" means the Coal Industry Nationalisation Act 1946[2].

    Provisions coming into force on 31st October 1994
        2.    The provisions of the Act specified in column 1 of Schedule 1 to this Order (which relate to the matters specified in column 2 thereof) shall come into force on 31st October 1994.
    Provisions coming into force on 1st November 1994
        3.    The provisions of the Act specified in column 1 of Schedule 2 to this Order (which relate to the matters specified in column 2 thereof) shall come into force on 1st November 1994.
    Transitional provision
        4.—(1)  This article shall have effect until the coming into force of the repeal by the Act[3] of section 56 of the 1946 Act.

        (2)  Section 56 of the 1946 Act shall have effect with the following modifications—
       (a) the insertion after the words "this Act" in the second place in which they occur in subsection (1) and in the first place in which they occur in subsection (2) of the words "or the Coal Industry Act 1994"; and
       (b) the substitution for the words "this Act" in the third place in which they occur in subsection (1) and in the second place in which they occur in subsection (2) of the words "those Acts".
