The Environmentally Sensitive Areas Designation (Radnor) (Welsh Language Provisions) Order 1994

Whereas, pursuant to section 18(1) of the Agriculture Act 1986[1], the Secretary of State has by order designated as an environmentally sensitive area an area of land in the District of Radnorshire in the County of Powys[2]; And whereas, pursuant to section 18(4) of the said Act, the Secretary of State has specified in the order designating the above-mentioned area the requirements as to agricultural practices, methods and operations and the installation or use of equipment which must be included in agreements made under section 18(3) of the said Act as respects agricultural land in that area; Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 18(1), (4) and (11) of the said Act, as extended by section 26(3) of the Welsh Language Act 1993[3], and of all other powers enabling him in that behalf, with the consent of the Treasury, hereby makes the following Order:- Citation, commencement and interpretation 1.(1) This Order may be cited as the Environmentally Sensitive Areas Designation (Radnor) (Welsh Language Provisions) Order 1994 and shall come into force on 1st September 1994.
(2) In this Order-"agreement" means an agreement under section 18(3) of the Agriculture Act 1986; "the designated area" means the area designated by article 3 of the Order; "the Order" means the Environmentally Sensitive Areas (Radnor) Designation Order 1993[4]; "requirements" means requirements as to agricultural practices, methods and operations and the installation or use of equipment specified in an order made under section 18 of the Agriculture Act 1986 and which must be included in an agreement.
(3) Except where otherwise expressly provided, any reference in this Order to a numbered Schedule shall be construed as a reference to the Schedule bearing that number in this Order.
Prescribed forms of words in Welsh for definitions, requirements, additional provisions and conservation plan operations 2. The requirements and definitions specified in Schedule 1 are hereby prescribed as separate forms of words in Welsh which may be included in an agreement as respects land in the designated area in place of the definitions and requirements respectively specified in article 2(1) of and Schedule 1 to the Order. 3. The additional provisions and definitions specified in Schedule 2 are hereby prescribed as separate forms of words in Welsh which may be included in an agreement as respects land in the designated area in place of the definitions and additional provisions respectively specified in article 2(1) of and Schedule 2 to the Order. 4. The additional provisions and definitions specified in Schedule 3 are hereby prescribed as separate forms of words in Welsh which may be included in an agreement as respects land in the designated area in place of the definitions and additional provisions respectively specified in article 2(1) of and Schedule 3 to the Order. 5. The conservation plan operations and definitions specified in Schedule 4 are hereby prescribed as separate forms of words in Welsh which may be included in an agreement as respects land in the designated area in place of the definitions and the conservation plan operations respectively specified in article 2(1) of and Schedule 4 to the Order.
