The Food Labelling (Amendment) Regulations 1993

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Health and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 16(1)(e) and 48(1) of the Food Safety Act 1990[1] and of all other powers enabling them in that behalf, hereby make the following Regulations, after consultation in accordance with section 48(4) of the said Act with such organisations as appear to them to be representative of interests likely to be substantially affected by the Regulations: Title, commencement and extent 1.(1) These Regulations may be cited as the Food Labelling (Amendment) Regulations 1993 and shall come into force on 29th November 1993.
(2) These Regulations extend to England and Wales.
Amendment of the Food Labelling Regulations 2. In Schedule 7 to the Food Labelling Regulations 1984[2] the entries relating to "shandy", "shandygaff", "ginger beer shandy", "cider shandy", "cider shandygaff" and "cider and ginger beer shandy" shall be deleted. In witness whereof the Official Seal of the Minister of Agriculture, Fisheries and Food is hereunto affixed on 27th October 1993.

EXPLANATORY NOTE
(This note is not part of the Regulation)These Regulations, which apply to England and Wales, come into force on 29th November 1993.
The Regulations further amend the Food Labelling Regulations 1984 by removing from Schedule 7 to those Regulations the entries relating to shandy, shandygaff, ginger beer shandy, cider shandy, cider shandygaff and cider and ginger beer shandy (regulation 2). Prior to this amendment the use of any of these descriptions in relation to a drink other than in accordance with the appropriate accompanying conditions was to apply a misleading description to that drink, contrary to the requirements of regulation 38(1) of the Food Labelling Regulations 1984.
