The Cosmetic Products (Safety) (Amendment) Regulations 1993

    Whereas the Secretary of State is a Minister designated[1] for the purposes of section 2 of the European Communities Act 1972[2] in relation to measures for safety and consumer protection as respects cosmetic products and any provisions concerning the composition, labelling, marketing, classification or description of cosmetic products and in relation to indication of origin on imported goods:
    Now, therefore, the Secretary of State in exercise of powers conferred on him by section 2 of the said Act of 1972 hereby makes the following Regulations:—
        1.—(1)  These Regulations may be cited as the Cosmetic Products (Safety) (Amendment) Regulations 1993 and except as provided by paragraph (2) below shall come into force on 21st June 1993.

        (2)  Regulation 2(b) and regulation 2(c) shall come into force—

      (a)  on 1st July 1993 in relation to the supply of cosmetic products by the manufacturer in or importer into the United Kingdom, or in the case of cosmetic products manufactured or imported into the United Kingdom on behalf of another person, by that other person, except where the cosmetic products are supplied by retail in which case they shall come into force on 1st July 1994; and

      (b)  in all other cases on 1st July 1994.

        2.    The Cosmetic Products (Safety) Regulations 1989[3] are hereby amended—

EXPLANATORY NOTE

(This note is not part of the Regulations)

    These Regulations amend the Cosmetic Products (Safety) Regulations 1989 (S.I.1989/2233) ("the Principal Regulations") as amended by the Cosmetic Products (Safety) (Amendment) Regulations 1990 (S.I.1990/1812), the Cosmetic Products (Safety) (Amendment) Regulations 1991 (S.I.1991/447) and the Cosmetic Products (Safety) (Amendment) Regulations 1992 (S.I. 1992/1525).
    They implement Commission Directive 92/86/EEC (O.J.No L325, 11.11.92, p. 18) byamending the Principal Regulations to—
        1.  Prohibit 12 substances from use in cosmetic products, the substances being Bis(hydroxyalkyl)amines, not further N-substituted (secondary dialkanolamines); colouring agent CI 15585; 2-(2,4-Diaminophenyl)ethanol and itssalts; 1,2-Epoxybutane; 4-Ethoxy-m-phenylenediamine and its salts; Nitrosamines; Pramocaine (INN); Pramoxine; Pyrocatechol; Pyrogallol; Strontium lactate; Strontium nitrate; and Strontium polycarboxylate (regulation 2(b)).

        2.  Delete certain of the warning labelling requirements in respect of certain Phenylenediamines, Methylphenylenediames and their N-substituted derivatives and salts, and Diaminophenols (regulation 2(c)(i)).

        3.  Permit, subject to restrictions, the use of Hydrogen peroxide in oral hygiene products (regulation 2(c)(iii)).

        4.  Permit, subject to restrictions, the use of Strontium chloride hexahydrate and Strontium acetate hemihydrate in toothpaste, impose labelling requirements in respect of talcum powders intended to be used for children under 3 years of age,and permit, subject to restrictions, the use of Fatty acid dialkanolamides,Monoalkanolamines and Trialkanolamines in cosmetic products (regulation 2(c)(iv)).

        5.  Delete the provisional use of 1,1,1-Trichloroethane (regulation 2(d)).

        6.  Permit, subject to restrictions, the use of colouring agent CI 26100 (regulation 2(e)).

        7.  Delete from the list of provisionally approved colouring agents Solvent Yellow 98, CI 73900 and CI 74180 (regulation 2(f)).

        8.  Permit as a preservative in cosmetic sunscreen products the use of 1,2-Dibromo-2,4-dicyanobutane at a maximum concentration of 0.025 per cent, and permit ona permanently approved basis the use subject to limitation as a preservative of Hexamidine (INN).Extend the allowed use of 7 provisionally allowed preservatives until 30th June 1993 and permit provisionally subject to restrictions the use of 2 others (regulation 2(g) and (h)).

        9.  Delete three provisionally permitted UV filters, N-propoxylated ethyl 4-bisaminobenzoate, mixed isomers; Glycerol 1-(4-aminobenzoate); and Mexenone (INN) (regulation 2(i)(i)).

        10.  Extend subject to restrictions the permitted use of 13 UV filters in cosmetic products until 30th June 1993 (regulation 2(i)(ii)).
