LOCAL GOVERNMENT, ENGLAND AND WALES CHANGES IN LOCAL GOVERNMENT AREAS

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972[1] and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47,48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England: Citation and commencement 1.(1) This Order may be cited as the North Yorkshire and West Yorkshire (County Boundaries) Order 1992.
(2) This Order shall come into force on 20th August 1992 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976[2].
(3) For all other purposes, this Order shall come into force on 1st. April 1993.
Interpretation 2. In this Order"district" includes a borough or city;
any reference to Harrogate, Leeds or Selby is a reference to the district of that name;
"the map" means one of the 12 maps prepared by the Department of the Environment, marked "Maps of the North Yorkshire and West Yorkshire (County Boundaries) Order 1992", duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;
"North Yorkshire" means the county of North Yorkshire, and "electoral division" means an electoral division of that county;
"ward" means a ward of the district to which an area is transferred, except in the expression "parish ward ", where it means a ward of the parish to which an area is transferred; and
"West Yorkshire" means the metropolitan county of West Yorkshire.
Transfers from North Yorkshire (Harrogate and Selby) to West Yorkshire (Leeds) 3. Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from North Yorkshire, and from the district and parish mentioned in column 3 to (c) the parish, parish ward (if any), ward, and petty sessional division mentioned in column 4; and to (d) the West Yorkshire Eastern coroner's district. Transfers from West Yorkshire to North Yorkshire 4.(1) Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from West Yorkshire, from Leeds, and from the parish mentioned in column 3 to (b) the district and the parish mentioned in column 4; (c) the ward and electoral division so mentioned; and to (d) the Claro coroner's district. (2) All areas shown in the Table in paragraph (1) shall additionally be transferred to the Claro petty sessional division with the exception of the area marked B on map 11, which shall be transferred to the Selby petty sessional division.
Consequential transfer between parishes within Leeds 5. The part of the parish of Harewood which is marked C on map 8 shall be transferred to the parish of East Keswick and to the Wetherby ward of Leeds. Town and country planning 6.(1) In this article, "provision" means a provision of a development plan as defined in section 336 of the Town and Country Planning Act 1990[3].
(2) Any provision of a plan applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

EXPLANATORY NOTE
(This note is not part of the Order)This Order transfers small areas between the county of North Yorkshire and the metropolitan county of West Yorkshire. The boundaries of the city of Leeds with the borough of Harrogate and with the district of Selby are affected. Consequential changes are made to local government electoral areas, petty sessional divisions and coroners' districts.
The map and table forming part of this note (Pages 5 and 6) give a general guide to the areas affected. Prints of the detailed order maps (described in article 2) may be inspected at all reasonable times at the offices of Harrogate Borough Council, of the Leeds City Council and of the Selby District Council, and additionally at the offices of the Secretary of State for the Environment located in 2, Marsham Street, London SW1P 3EB.
In approximate terms, the land transferred from North Yorkshire to West Yorkshire has a total area of 90 hectares and a population of 280, while the land transferred from West Yorkshire to North Yorkshire has a total area of 614 hectares and a population of 70.
