The Weighing Equipment (Non-automatic Weighing Machines) (Amendment) Regulations 1991

The Secretary of State, in exercise of the powers conferred by sections 15(1) and 86(1) of the Weights and Measures Act 1985[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations: 1. These Regulations may be cited as the Weighing Equipment (Non-automatic Weighing Machines) (Amendment) Regulations 1991 and shall come into force on10th September 1991. 2. The Weighing Equipment (Non-automatic Weighing Machines) Regulations 1988[2] are hereby further amended as follows- (a) in regulation 4(1), for the words "1st September 1991", there shall be substituted the words "30th December 1992"; (b) in regulation 11(4), for the words "section 14(3)" where they first occur, there shall be substituted the words "section 15(5)"; (c) in regulation 35(2) for the words "as from 1st September 1991", there shall be substituted the words "on and after 30th December 1992"; and (d) in Schedule 4, in paragraph 3(a), for the word "Regulation 41(1)", there shall be substituted the words "regulation 41(2)".

EXPLANATORY NOTE
(This note is not part of the Regulations)These Regulations further amend the Weighing Equipment (Non-automatic Weighing Machines) Regulations 1988. They correct drafting errors and make the following changes of substance-(a) they defer from 1st September 1991 to 30th December 1992 the prohibition on the use for trade of a weighing machine marked with a weighing range for the purpose of determining the mass of loads which are outside that range (regulation 2(a)); and
(b) in the case of a machine marked with an approved minimum load, they defer for a similar period the disapplication of provisions relating to limits of error for test loads of lower amounts (regulation 2(c)).
