The River Tweed (Baits and Lures) Regulations 1991

The Secretary of State, on application to him by the River Tweed Council, having carried out all necessary consultations and complied with all necessary procedures and considered the representations and objections made as required by paragraphs 3, 4 and 7 of Schedule 1 to the Salmon Act 1986[1], as applied by section 8(5) of that Act, in exercise of the powers conferred on him by section 8 of that Act and of all other powers enabling him in that behalf, hereby makes the following Regulations: Citation and commencement 1. These Regulations may be cited as the River Tweed (Baits and Lures) Regulations 1991 and shall come into force on 1st January 1992. Specification of baits and lures and area of application 2. Natural prawns and shrimps (whether fresh or preserved, dyed or natural colour) and any part thereof are, in relation to the River Tweed, specified for the purposes of the definition of "rod and line" in section 24(1) of the Salmon and Freshwater Fisheries (Protection) (Scotland) Act 1951[2]. Revocation 3. The River Tweed (Baits and Lures) Regulations 1988[3] are hereby revoked.

EXPLANATORY NOTE
This note is not part of the Regulations)These Regulations specify natural prawns and shrimps and any part of them for the purposes of the definition of "rod and line" in section 24(1) of the Salmon and Freshwater Fisheries (Protection) (Scotland) Act 1951. They apply to the River Tweed and its tributaries (including that part of the River Tweed which is situated in England) for the whole of each year. The effect is to prohibit the use of natural prawns and shrimps (or any part of them) as bait when fishing by rod and line for salmon and sea trout. These Regulations revoke the River Tweed (Baits and Lures) Regulations 1988 which prohibited the use of natural prawns and shrimps as bait during the period from 1st June to 14th September in each year.
