The Certification Officer (Amendment of Fees) Regulations 1991

    The Secretary of State, in exercise of the powers conferred by section 7 of the Trade Union (Amalgamations, etc.) Act 1964[1]and now vested in him by the Secretary of State for Employment and Productivity Order 1968[2], and section 8(4) of the Trade Union and Labour Relations Act 1974[3], and section 8(2) of the Employment Protection Act 1975[4]and of all other powers enabling him in that behalf, and as respects regulations 2 and 3 with the approval of the Treasury, hereby makes the following Regulations:
    Citation, commencement and revocation
        1.—(1)  These Regulations may be cited as the Certification Officer (Amendment of Fees) Regulations 1991 and shall come into force on 1st April 1991.

        (2)  The following Regulations are hereby revoked—
       (a) Regulation 3 of the Certification Officer (Amendment of Fees) Regulations 1988[5];
       (b) Regulations 1 and 2 of the Certification Officer (Amendment of Fees) Regulations 1989[6];
       (c) The Certification Officer (Amendment of Fees) Regulations 1990[7].

    Amendment of fees payable to the Certification Officer
        2.    In paragraph (1) of regulation 11 of the Trade Unions and Employers' Associations (Amalgamations, etc.) Regulations 1975[8](fees to accompany an application for approval of a proposed instrument of amalgamation or transfer) for the words "£290" there shall be substituted the words "£645".
        3.    In paragraph (2) of regulation 11 of the Trade Unions and Employers' Associations (Amalgamations, etc.) Regulations 1975 for the words "£14" there shall be substituted the words "£15" (fee on an application for approval of a change of name).
        4.    The fee of £45 is hereby prescribed for the purposes of section 8(4) of the Trade Union and Labour Relations Act 1974 (fee on application by an organisation of workers or of employers to have its name entered in the list of trade unions or employers' associations).
        5.    The fee of £305 is hereby prescribed for the purposes of section 8(2) of the Employment Protection Act 1975 (fee on application by a trade union for a certificate of independence).

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations, which come into force on 1st April 1991, increase certain fees payable to the Certification Officer. The fees are increased as follows:—
      (a) from £290 to £645 on an application for approval of a proposed instrument of amalgamation or transfer;
      (b) from £14 to £15 on an application for approval of a change of name;
      (c) from £40 to £45 on an application by an organisation of workers or of employers to have its name entered in the list of trade unions or employers' associations maintained by the Certification Officer;
      (d) from £275 to £305 on an application by a trade union for a certificate of independence.
