The Queen's Most Excellent Majesty in Council
Her Majesty, in pursuance of section 1 of the Ministers of the Crown Act 1975[1], is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows: Citation and commencement 1.(1) This Order may be cited as the Transfer of Functions (Radioactive Substances) (Wales) Order 1990.
(2) This Order shall come into force on 29th January 1991.
Transfer of functions 2. The functions of the Minister of Agriculture, Fisheries and Food under any of the amendments of the Radioactive Substances Act 1960[2] specified in Part V of and Schedule 5 to the Environmental Protection Act 1990[3], so far as exercisable in relation to Wales, are hereby transferred to the Secretary of State and references to that Minister in any of those amendments shall be construed accordingly.

EXPLANATORY NOTE
(This note is not part of the Order)Article 2 of, and Schedule 1 to, the Transfer of Functions (Wales) (No. 1) Order 1978 (S.I. 1978/272) transferred functions of the Minister of Agriculture, Fisheries and Food under the Radioactive Substances Act 1960, as referred to in that Order, so far as those functions were exercisable in relation to Wales, to the Secretary of State. The 1960 Act is amended by Part V of, and Schedule 5 to, the Environmental Protection Act 1990. The present Order transfers the functions of the Minister of Agriculture, Fisheries and Food under those amendments, so far as exercisable in relation to Wales, to the Secretary of State.
