The Local Government Act 1988 (Defined Activities) (Exemption) (England) (No. 3) Order 1990

The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation and commencement
1.(1) This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (England) (No. 3) Order 1990 and shall come into force on 13th November 1990.
Exemption
2. The managing of sports and leisure facilities by Kennet District Council at the premises known as the Marlborough Leisure Centre shall not be treated as a defined activity within the meaning of section 2(2) (ee) of the Local Government Act 1988[2] so long as the premises remain vested in that council and remain subject to a right of Marlborough College to use the facilities.

EXPLANATORY NOTE
(This note is not part of the Order)Under Part I of the Local Government Act 1988 work falling within certain defined activities may only be carried out by local authorities if particular conditions are fulfilled.
This Order exempts from the requirements of Part I the management by Kennet District Council of sports and leisure facilities at Marlborough Leisure Centre, so long as specified conditions are met.
