The Design Right (Proceedings before Comptroller) (Amendment) Rules 1990

    The Secretary of State, in exercise of the powers conferred upon him by section 250 of the Copyright, Designs and Patents Act 1988[1] and after consultation with the Council on Tribunals in accordance with section 10(1) of the Tribunals and Inquiries Act 1971[2], hereby makes the following Rules:—
        1.    These Rules may be cited as the Design Right (Proceedings before Comptroller) (Amendment) Rules 1990 and shall come into force on 13th August 1990.
        2.    Rule 6(4) of the Design Right (Proceedings before Comptroller) Rules 1989[3] is amended—
       (a) in sub-paragraph (a), by inserting at the end thereof the words "or section 276 of the Act"; and
       (b) in sub-paragraph (b), by substituting for the words "the Patents Act 1977" the words "section 275 of the Act".

EXPLANATORY NOTE

(This note is not part of the Rules)
    These Rules amend rule 6 of the Design Right (Proceedings before Comptroller) Rules 1989 (which authorises the Comptroller to refuse to recognise certain persons as agents in respect of any proceedings before him) to take account of the coming into force of sections 275 (register of patent agents) and 276 (persons entitled to describe themselves as patent agents) of the Copyright, Designs and Patents Act 1988.
