The Social Security (Attendance Allowance) Amendment Regulations 1990

The Secretary of State for Social Security, in exercise of powers conferred by section 35(5) of, and Schedule 20 to the Social Security Act 1975[1], and of all other powers enabling him in that behalf, by this instrument, which contains regulations which relate only to matters which in accordance with section 140 of the Act of 1975 have been referred to the Attendance Allowance Board[2], hereby makes the following Regulations:
Citation and commencement
1. These Regulations may be cited as the Social Security (Attendance Allowance) Amendment Regulations 1990 and shall come into force on 9th April 1990.
Amendment of the Social Security (Attendance Allowance) (No. 2) Regulations 1975
2. In regulation 6(2) of the Social Security (Attendance Allowance) (No. 2) Regulations 1975[3] (modification of section 35(1) to (4) of the Act in its application to children) the words "who has attained the age of 2 and" shall be omitted.

EXPLANATORY NOTE
(This note is not part of the Regulations)These Regulations amendthe Social Security (Attendance Allowance) (No. 2) Regulations 1975 by removing the restriction on entitlement to attendance allowance for children under two years of age (regulation 2).
