The Macduff (Pilotage Powers) Order 1989

    Whereas the Grampian Regional Council is a harbour authority within the meaning of the Pilotage Act 1987[1] but is not a competent harbour authority within the meaning of that Act in respect of the harbour of Macduff, and whereas it wishes to be treated for the purposes of the Act as such an authority, now therefore the Secretary of State for Transport on the application of the Grampian Regional Council, in exercise of the powers conferred on him by section 1(4) of the Pilotage Act 1987, and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Macduff (Pilotage Powers) Order 1989, and shall come into force on 1st November 1989.
    Interpretation
        2.    In this Order "the Council" means the Grampian Regional Council and "the harbour of Macduff" means the Macduff Harbour Area as defined in Schedule 1 of the Grampian Regional Council (Harbours) Order 1987 confirmed by the Grampian Regional Council (Harbours) Order Confirmation Act 1987[2].
    Application of Pilotage Act 1987
        3.    The Council shall be a competent harbour authority in respect of the harbour of Macduff for the purposes of the Pilotage Act 1987.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order provides that the Grampian Regional Council, which is a competent harbour authority for the purposes of the Pilotage Act 1987 in respect of the harbours of Buckie and Burghead, shall also be a competent harbour authority for those purposes in respect of the harbour of Macduff.
    The applicant for this Order is the Grampian Regional Council.
