The Social Security (Contribution Conditions for Unemployment and Sickness Benefit) Transitional Regulations 1989

    The Secretary of State for Social Security, in exercise of powers conferred by section 18(4) of the Social Security Act 1988[1] and of all other powers enabling him in that behalf, after agreement by the Social Security Advisory Committee that the proposals to make these Regulations need not be referred to it[2], hereby makes the following Regulations:
    Citation, commencement and interpretation
        1.—(1)  These Regulations may be cited as the Social Security (Contribution Conditions for Unemployment and Sickness Benefit) Transitional Regulations 1989 and shall come into force on 1st September 1989.

        (2)  In these Regulations-
      "the 1975 Act" means the Social Security Act 1975[3];
      "the 1988 Act" means the Social Security Act 1988;
      "day of interruption of employment" and"period of interruption of employment" shall be construed in accordance with section 17 of the 1975 Act.

    Savings provision relating to the contribution conditions for unemployment and sickness benefit
        2.    Where on or after 1st September 1989 a person has a day of interruption of employment and that day falls within a period of interruption of employment which began before 1st January 1978, Schedule 3 to the 1975 Act shall apply in his case as though the amendments made to it by section 6 of the 1988 Act (contribution conditions for short-term benefits) had not been enacted.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations make savings provisions in connection with the commencement on 2nd October 1988 of section 6 of the Social Security Act 1988 which relates to contribution conditions for unemployment and sickness benefit. Where a person has a day of unemployment or incapacity for work and that day falls within a period of interruption of employment which began before 1st January 1978, the contribution conditions for unemployment benefit and sickness benefit in his case are those which applied prior to the changes introduced by section 6.
