The Building (Amendment of Prescribed Fees) Regulations 1989

    The Secretary of State, in exercise of the powers conferred upon him by sections 1, 3, 16(10), 34, 35, 50(3) and 126[1] of, and paragraphs 2, 5 and 10(c) of Schedule 1 to, the Building Act 1984[2], and all other powers enabling him in that behalf, hereby makes the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Building (Amendment of Prescribed Fees) Regulations 1989 and shall come into force on 1st September 1989.
    Amendment of the Building (Prescribed Fees etc.) Regulations 1985
        2.    The Building (Prescribed Fees etc.) Regulations 1985[3] are amended as follows-

        (1)  in Schedule 1 there shall be substituted—
       (a) for "£80" in paragraphs 2 and 5, "£88", and
       (b) for Tables 1 and 2, the following Tables-

        (2)  in Schedule 2 there shall be substituted-
       (a) in paragraph 1 for "£11", "£33" and "£44" respectively, "£14", "£43" and "£57".
       (b) for the Table in paragraph 2, the following Table-

    Transitional Provisions
        3.    These Regulations shall not affect the application of the Building (Prescribed Fees etc) Regulations 1985 in relation to work in respect of which-

        (1)   a building notice was given or full plans were deposited (under regulation 11 of the Building Regulations 1985[4]; or

        (2)   an initial notice or a public body's notice was given (under section 47(1) or 54(1) of the Building Act 1984), before 1st September 1989, notwithstanding that on or after that date a notice is or has been given, or plans are or have been deposited, in respect of substantially the same work.
    Revocations
        4.    The Building (Amendment of Prescribed Fees) Regulations 1988[5] are hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Building (Prescribed Fees etc.) Regulations 1985 so as to increase the flat rate fees payable to a local authority.
        (1)  by approximately 10% in respect of the erection of small domestic buildings and connected work (Schedule 1 to the 1985 Regulations), and

        (2)  by approximately 30% in respect of the erection of certain garages, carports and the making of small extensions and alterations to domestic buildings (Schedule 2 to the 1985 Regulations).

    Transitional provisions are contained in regulation 3. Regulation 4 revokes the Building (Amendment of Prescribed Fees) Regulations 1988 which are superseded by these Regulations.
