PLANT HEALTH
The Plant Health (Great Britain) (Amendment) (No. 2) Order 1989

The Minister of Agriculture, Fisheries and Food in relation to England, the Secretary of State for Scotland in relation to Scotland and the Secretary of State for Wales in relation to Wales, in exercise of the powers conferred by sections 1(2)(b) and 3(1) of the Plant Health Act 1967[1] and now vested in them[2] and of all other powers enabling them in that behalf, hereby make the following Order:
Title, extent and commencement
1. This Order may be cited as the Plant Health (Great Britain) (Amendment) (No. 2) Order 1989, shall apply to Great Britain and shall come into force on 14th July 1989.
Amendment of the Plant Health (Great Britain) Order 1987
2. The Plant Health (Great Britain) Order 1987[3] shall be amended as follows:-
(1) in section A of Part III of Schedule 1 after the words "4. Ditylenchus dipsaci (Kühn) Filipjev - Stem Nematode" there shall be inserted the following - "5. Frankliniella occidentalis (Pergande) - Western Flower Thrips"; and
(2) in Part IIA of Schedule 3 in column 2 of Item 4 for the words "The Import and Export of Trees, Wood and Bark (Health) (Great Britain) Order 1980" there shall be substituted the words "The Plant Health (Forestry) (Great Britain) Order 1989", and the corresponding footnote shall read "S.I. 1989/823".

EXPLANATORY NOTE
(This note is not part of the Order)This Order further amends the Plant Health (Great Britain) Order 1987 by adding Western Flower Thrips (Frankliniella occidentalis (Pergande)) to the list of plant pests which may be kept etc. in Great Britain and need not be notified. The Order also updates the reference to an Order made by the Forestry Commission (article 2).
