The Certification Officer (Amendment of Fees) Regulations 1989

    The Secretary of State, in exercise of the powers conferred on him by section 7 of the Trade Union (Amalgamations, etc.) Act 1964[1] and section 8(2) of the Employment Protection Act 1975[2] and of all other powers enabling him in that behalf, and as respects regulation 2 with the approval of the Treasury, hereby makes the following Regulations:-
    Citation, commencement and revocation
        1.—(1)  These Regulations may be cited as the Certification Officer (Amendment of Fees) Regulations 1989 and shall come into force on 1st April 1989.

        (2)  The following Regulations are hereby revoked-
       (a) Regulation 4 of the Trade Unions and Employers' Associations (Amalgamations, etc.) (Amendment) Regulations 1978[3];
       (b) Regulation 4 of the Certification Officer (Amendment of Fees) Regulations 1988[4].

    Amendment of fees payable to the Certification Officer
        2.    In paragraph (1) of regulation 11 of the Trade Unions and Employers' Associations (Amalgamations, etc.) Regulations 1975[5] (fee to accompany an application for approval of a proposed instrument of amalgamation or transfer) for the words "£175" there shall be substituted the words "£200".
        3.    The fee of £225 is hereby prescribed for the purposes of section 8(2) of the Employment Protection Act 1975 (fee on application by a trade union for a certificate of independence).

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations, which come into force on 1st April 1989, increase the fee payable to the Certification Officer on an application for approval of a proposed instrument of amalgamation or transfer from £175 to £200 and the fee payable to him on an application by a trade union for a certificate of independence from £194 to £225.
