The School Curriculum Development Committee and Secondary Examinations Council (Transfer of Property) Order 1988

    In exercise of the powers conferred on the Secretary of State by section 15(2) of the Education Reform Act 1988[1], the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Order:
    Citation and Commencement
        1.    This Order may be cited as the School Curriculum Development Committee and Secondary Examinations Council (Transfer of Property) Order 1988, and shall come into force on 3rd January 1989.
    Transfer of Property etc to the Councils
        2.    The property, rights and liabilities of the School Curriculum Development Committee and the Secondary Examinations Council hereinafter described, being property, rights and liabilities which in the opinion of the Secretary of State require to be transferred to the National Curriculum Council, the Curriculum Council for Wales and the School Examinations and Assessment Council for the purpose of enabling those Councils properly to perform their respective functions, shall on 3rd January 1989 be transferred and vest as hereinafter provided.
        3.—(1)  All rights and liabilities in respect of the lease dated 10th June 1985 and made between the Halcrow Partnership of the one part and the School Curriculum Development Committee of the other part of its pemises at Newcombe House, 45 Notting Hill Gate, London W11 and all property of the School Curriculum Development Committee held therein immediately before this Order comes into force exclusively for its purposes, other than its files, records, accounts and working papers and the property listed in Schedule 1, shall vest in the School Examinations and Assessment Council.

        (2)  All rights and liabilities of the School Curriculum Development Committee in respect of the lease dated 14th February 1985 and made between H. W. D. Burgess and others of the first part and the School Curriculum Development Committee of the other part of its premises at Castle Buildings, Womanby Street, Cardiff and all property held therein immediately before this Order comes into force shall vest in the Curriculum Council for Wales.

        (3)  There shall vest in the National Curriculum Council:
       (a) the property of the School Curriculum Development Committee listed in Schedule 1; and
       (b) all interests, rights and liabilities of the School Curriculum Development Committee in the company known as SCDC Publications; and
       (c) all other property, rights and liabilities whatsoever of the School Curriculum Development Committee, with the exception of the property, rights and liabilities transferred to the School Examinations and Assessment Council and the Curriculum Council for Wales by paragraphs (1) and (2) of this Article.

        4.—(1)  All property, rights and liabilities of the Secondary Examinations Council including all rights and liabilities in respect of the leases dated 10th June 1985 and 25th March 1987 and made between the Halcrow Partnership of the one part and the Secondary Examinations Council of the other part of its premises at Newcombe House, 45 Notting Hill Gate, London W11 and all furniture, equipment, and records held therein immediately before this Order comes into force for its purposes, other than the property listed in Schedule 2, shall vest in the School Examinations and Assessment Council.

        (2)  The property of the Secondary Examinations Council listed in Schedule 2 shall vest in the National Curriculum Council.
