The Wireless Telegraphy (Control of Interference from Citizens' Band Radio Apparatus) (Amendment) Regulations 1988

The Secretary of State, in exercise of the powers conferred by section 10 of the Wireless Telegraphy Act 1949[1] as enacted, and as extended by the Wireless Telegraphy (Channel Islands) Order 1952[2] and the Wireless Telegraphy (Isle of Man) Order 1952[3] and now vested in him[4], hereby makes the following Regulations: 1. These Regulations may be cited as the Wireless Telegraphy (Control of Interference from Citizens' Band Radio Apparatus) (Amendment) Regulations 1988 and shall come into force on 8th August 1988. 2. In these Regulations
"the principal Regulations" means the Wireless Telegraphy (Control of Interference from Citizens' Band Radio Apparatus) Regulations 1982[5]. 3. In regulation 2 of the principal Regulations, for the definition of "relevant specification" there shall be substituted the following definition:
"relevant specification" means Performance Specification MPT 1321, as amended, published in April 1981.

EXPLANATORY NOTE
(This note is not part of the Regulations)The Regulations delete the requirements applicable to CB apparatus which operates in the frequency band 27.60125 MHz to 27.99125 MHz. CB apparatus which operates in the frequency band 26.1 MHz to 28 MHz is now subject to the Wireless Telegraphy (Citizens' Band and Amateur Apparatus) (Various Provisions) Order 1988.
A person who fails to comply with the Regulations may be served with a notice under section 12 of the Wireless Telegraphy Act 1949 and any person who contravenes such a notice is guilty of an offence under the Act and may be liable on summary conviction to a fine not exceeding level 3 on the standard scale.
