The Road Traffic Act 1972 (Amendment) Regulations 1988

The Secretary of State for Transport, in exercise of the powers conferred by section 9(5) of the Road Traffic Act 1974[1], now vested in him[2] and of all other enabling powers, hereby makes the following Regulations:
1. These Regulations may be cited as the Road Traffic Act 1972 (Amendment) Regulations 1988 and shall come into force on 13th July 1988.
2. In section 190(11) of the Road Traffic Act 1972[3], the words "except sections 68 to 81" shall cease to have effect.

EXPLANATORY NOTE
(This note is not part of the Regulations)Sections 68 to 81(1) and part of 82 of the Road Traffic Act 1972 were repealed by section 24(3) and Schedule 7 to the Road Traffic Act 1974. Section 9(5) of the 1974 Act enables the Secretary of State by regulations to make such amendments as he considers appropriate to take account of the preceding provisions of that section in any enactment which refers to any provision of sections 68 to 82 of the 1972 Act which was repealed by the 1974 Act.
These Regulations are made under section 9(5) of the 1974 Act and amend section 190(11) of the 1972 Act (power of Secretary of State to make regulations varying maximum or minimum weights specified in definitions of expressions relating to motor vehicles) to take account of section 9(3) of the 1974 Act (which amends section 81(2) of the 1972 Act).
