The Heavy Goods Vehicles (Drivers' Licences) (Amendment) Regulations 1988

The Secretary of State for Transport, in exercise of the powers conferred by sections 119(1) and 124 of the Road Traffic Act 1972[1], now vested in him[2], and all other enabling powers, and after consultation with representative organisations in accordance with section 199(2) of that Act, hereby makes the following Regulations:
1. These Regulations may be cited as the Heavy Goods Vehicles (Drivers' Licences) (Amendment) Regulations 1988 and shall come into force on 27th June 1988.
2. The Heavy Goods Vehicles (Drivers' Licences) Regulations 1977[3] shall be further amended in accordance with the following provisions of these Regulations.
3. In regulation 23 (Fees for tests), for "£40" there shall be substituted "£42".
4. In regulation 24(b) (Refund of fees), for the word "three" there shall be substituted the word "ten".
5. Regulation 4 of these Regulations shall not apply in respect of the cancellation of an appointment made before 27th June 1988.

EXPLANATORY NOTE
(This note is not part of the Regulations)These Regulations further amend the Heavy Goods Vehicles (Drivers' Licences) Regulations 1977 by increasing the fee payable under regulation 23 thereof, by a person who applies for a driving test, from £40 to £42.
Regulation 24(b) of those Regulations is also amended so as to increase the period of notice required to cancel an appointment for a driving test, if the fee is to be repaid, from three to ten clear days. The three day notice period will remain in respect of appointments made before the date of coming into force of these Regulations.
