The Local Government Administration (Matters Subject to Investigation) Order 1988

Present,

The Queen's Most Excellent Majesty in Council

    Her Majesty, by virtue of and in exercise of the powers conferred on Her by section 26(9) of the Local Government Act 1974[1], is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
        1.    This Order may be cited as the Local Government Administration (Matters Subject to Investigation) Order 1988 and shall come into force on 1st April 1988.
        2.    Action taken by any authority other than a police authority in connection with the investigation or prevention of crime shall cease to be excluded by virtue of Schedule 5 to the Local Government Act 1974 from the matters subject to investigation by a Local Commissioner; and, accordingly, the word"police" shall be inserted before the word"authority" in paragraph 2 of that Schedule.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends Schedule 5 to the Local Government Act 1974 so that action taken in connection with the investigation or prevention of crime, hitherto totally excluded from investigation by a Commissioner for Local Administration, is so excluded only if it is undertaken by a police authority.
