The National Health Service (Food Premises) Regulations 1987

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Social Services, and the Secretary of State for Wales, acting jointly, in exercise of powers conferred by section 1(2)(a), (3), (4) and (7)(a) of the National Health Service (Amendment) Act 1986[1], and of all other powers enabling them in that behalf, hereby make the following Regulations: Citation, commencement and interpretation 1.(1) These Regulations may be cited as the National Health Service (Food Premises) Regulations 1987 and shall come into force on 7th February 1987.
(2) In these Regulations:"the food legislation" means the Food Act 1984[2] and any regulations or orders made under it; "health authority" has the meaning assigned to it by section 128 of the National Health Service Act 1977[3].
Occupiers or owners of health service premises for the purposes of the food legislation 2. A health authority shall be treated as both the owner and occupier of premises used by the health authority for the purposes of the food legislation. In Witness whereof the Official Seal of the Minister of Agriculture, Fisheries and Food is hereunto affixed on 14th January 1987.

EXPLANATORY NOTE
(This note is not part of the Regulations)These Regulations provide that health authorities in England and Wales shall be treated as both owners and occupiers of premises used by them for the purposes of the Food Act 1984 and any Regulations or Order made under that Act.
